Billing

  • Upon confirmation of the offer, 80% of the total amount will be invoiced to the client.

  • Payment must be made to confirm the project, and proof of payment must be provided. The payment should be received no later than the first day of production.

  • If the invoice is not paid, all project activities will be suspended until full payment is received. The client is responsible for any additional costs incurred due to the suspension or delay.

  • After the project's completion, the client will receive a final invoice for the remaining balance and any additional costs. Any deviations from the signed offer will be reflected in the final invoice.

  • Payment of the final invoice is due within 15 days. A monthly financing fee of 5% will be applied to any unpaid balances after this date. Any questions regarding the invoice must be raised within 7 days of the final invoice date.

  • All third-party costs (external suppliers, crew members, etc.) are to be paid directly and exclusively by the client to Locally Produced. The client is not permitted to pay project contributors directly unless this has been explicitly agreed upon with Locally Produced in advance.

  • All invoices are subject to 19% VAT, unless client is based outside of EU.

Terms

  • The client provides a detailed briefing and all necessary information to create an offer, budget estimate, and initiate the project.

  • Offers and budget estimates are based on the client's initial briefing, information, and requirements, and do not include overtime or additional requests.

  • Locally Produced reserves the right to reject specific requirements or suggestions from the client regarding cost elements if they create an unsafe and/or unhealthy working environment due to excessive cost-cutting.

  • Day rates are based on a 9-hour day, including a one-hour break. Overtime is billed at an additional 10% per hour of the day rate.

  • On production days (on-set execution), regular working days starting no earlier than 09:00 and ending no later than 19:00, a mandatory lunch fee of at least €20 per crew member will be paid by the client to the production company to provide lunch. Any workday starting before 09:00 incurs an additional fee of €12.50 per crew member for breakfast. Any workday ending after 19:00 incurs an additional fee of €35 per crew member for dinner.

  • Production days (on-set execution) starting before 07:00 or ending after 22:00 are subject to a 10% hourly surcharge for irregular hours per crew member.

  • Any travel time to and from the production location for the producer or a member of the production team (production manager, location manager, production assistant) will be counted as paid working hours.

  • If travel outside of Berlin, including overnight stays, is required, a per diem for meals will be paid by the client to each crew member to cover additional expenses. This per diem will be paid through Locally Produced to all crew members and is considered a flat rate, meaning no expense receipts are required. The per diem is €35/day for travel within Germany and €50/day for travel outside Germany.

  • All flight, airport transfer, and hotel costs will be covered by the client.

  • In the event of overnight stays between flights, the client will reimburse the hotel costs for each traveling crew member.

  • The estimated production costs in the contract may increase by up to 10% based on the actual production costs without consulting the client, and costs may be shifted between line items. Any changes to the briefing or task requirements may lead to additional costs and/or expenses beyond the stated 10%, in which case the client will be informed in advance.

  • Unless another document is signed by both parties, the budget agreement signed by both parties is binding.

  • The client is responsible for the content of the produced (visual) material.

  • All insurance claims will have a minimum deductible of €500 per incident. The client is also liable for all production crew members. Rented vehicles, photo, and film equipment are not covered under production liability insurance. The client is liable for any damages and associated costs.

  • The client retains ownership and responsibility for the content and commercial rights of the produced work at all times, unless otherwise agreed. All disputes with third parties or contributors to the project regarding artistic rights are the client's responsibility.

  • Locally Produced retains ownership of all documents and templates provided to support project execution, including but not limited to call sheets, budget sheets, and online tools. It is strictly prohibited to share these documents or tools with third parties or unauthorised persons unless explicitly authorised by the production company.

  • In case of any dispute, the place of jurisdiction is Berlin, Germany.

Cancellation

  • Once the booking is confirmed, the client is responsible for 100% of the production fees and any incurred expenses. Canceling the production at any stage of the project, including pre-production, does not release the client from this responsibility.

  • In the event of a rescheduling or cancellation of the production for any reason, including but not limited to: bad weather or force majeure, the client is responsible for all additional costs arising from this rescheduling or cancellation.

Confidentiality

  • The terms of any agreement between the production company and the client, including but not limited to fees, are to be kept strictly confidential by the client and not shared with third parties.
